TemperPack is committed to respecting and protecting your privacy. We are not responsible for the actions of those third parties, including their policies and practices with regard to your Personal Information.

Types of Information Collected

TemperPack collects two types of information from visitors to the Site, non-personal information and Personal Information. Non-personal information is information that does not, by itself, identify a visitor individually. Personal Information is information that identifies an individual or is reasonably capable of being associated with or linked, directly or indirectly, with an individual. It does not include aggregate, de-identified, or anonymous information. When you interact with us, we may ask you to supply us with Personal Information so that we can provide, enhance, and personalize our Services.

For example, TemperPack may collect Personal Information that you directly provide to us such as your name, address, telephone number, and email address. This information may be given when you sign up to receive TemperPack newsletters, or provide contact information about yourself to use our Services.

TemperPack also collects certain types of Personal Information automatically when you visit the Site, such as your IP address and device location.

TemperPack may automatically collect information during your visit to the Site such as page hits, number of visits, web pages viewed, length of visits, browser type and language, access times, the address of the website from which you arrived at the Site, and clickstream behavior (i.e., the pages you view, the links you click, and other actions you take in connection with TemperPack websites).

Cookies and Similar Technologies

Cookies

“Cookies” are pieces of information that a website transfers and stores on a visitor’s computer in order to store information about the visitor’s preferences, which such website can later retrieve. We may use cookies for certain limited purposes such as improving your experience by recognizing you when you visit the Site and allowing us to optimize the information presented based on your demonstrated areas of interest. Cookies may also be used to compile information about website usage. If you subsequently provide us with Personal Information such as your email address, we will associate any cookies on your browser with that information such that you will no longer be an anonymous visitor to the site.

Do Not Track

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Site does not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are on the Site and after you leave our Site.

Information Use and Sharing

We are committed to maintaining your trust, and we want you to understand when and with whom we may share information collected about you. We use your Personal Information to provide you with our Services as described below. We do not sell your personal information.

A. Authorized Service Providers and Contractors

We share your Personal Information with service providers and contractors for business purposes to help us with specialized services such as customer support, email deployment, business analytics, marketing, and data processing. For example, if you sign up for the TemperPack newsletter, TemperPack may use your contact information to send you the TemperPack newsletter. If you provide TemperPack with contact information or other information about yourself, we may use that information internally and to communicate with you regarding TemperPack’s products. Because TemperPack is committed to protecting your privacy, TemperPack will not sell, rent or otherwise disclose this information to any third party, except as described in this Privacy Policy. Personal information may be disclosed under the limited circumstances described below, and you agree that TemperPack may do so by submitting your Personal Information.

 

B. Google Analytics and Google AdWords

We use Google Analytics on our Site to help us analyze traffic and improve services. You may opt out of the use of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

We also use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to our Site. Any data we collect will be used in accordance with this Privacy Policy, and Google is responsible to abide by its own privacy policy. C. Third Parties

TemperPack may share Personal Information with third parties for business purposes, such as consultants and advisors to the company.

TemperPack may disclose your Personal Information to a third party if required to do so by law or if, in good faith, TemperPack believes that such action is necessary to: (1) comply with the law or with legal process; (2) protect and defend TemperPack’s rights and property or prevent fraud; (3) protect TemperPack against abuse, misuse, or unauthorized use of TemperPack’s products or services; or (4) protect the personal safety or property of its personnel, users of this Site, or the public.

The servers that serve the Site automatically identify a computer by its IP address. If TemperPack, in good faith, determines that you have used the Service to menace, threaten, harass, intimidate, or otherwise deceptively pose as another person, your actions will be investigated and your IP address may be disclosed to the recipient of any email, their legal counsel or representatives, and law enforcement officials as part of such an investigation.

TemperPack may transfer its database, including Personal Information contained therein, to a third party who acquires all or substantially all of the assets or stock of TemperPack whether by merger, acquisition, reorganization, or otherwise.

TemperPack may share non-personal information from which individuals cannot be identified, and which do not relate to individuals in aggregate form, with third parties for business purposes, such as consultants and advisors to the company.

Information Retention

We will only keep Your Personal Information for as long as necessary to fulfill the purposes for which we collect the information, as described in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. If you request the closure of your account, your data will be retained for a maximum of 90 days from closure.

How TemperPack Protects Your Information

We maintain industry-standard electronic, physical, and procedural safeguards to protect the security and integrity of your Personal Information. However, the storage, use, and transmission of information over the internet can never be made 100% secure. Accordingly, we do not warrant the security or confidentiality of your Personal Information, and you provide such information to us at your own risk.

Specifically, if you submit business plan ideas, financials, or other proprietary information to TemperPack through the Site, TemperPack CANNOT AND WILL NOT ACCEPT RESPONSIBILITY for protecting against misuse or disclosure of any confidential or proprietary information included in such materials, in the absence of TemperPack’s express, signed written agreement to do so.

International Visitors

TemperPack is controlled and operated in the United States, and use of our Services is only intended for customers in the United States and Canada. If you are located outside of the United States and Canada, please do not use the Services. By providing any Personal Information to the Site or using our Services, all users, including without limitation users in the European Union, fully understand and unambiguously consent to the collection and processing of such information in the United States, which may not be as protective or comprehensive as those in your home jurisdiction.

Linked Websites

Our Services (including, without limitation, this Site and such features as TemperPack’s newsletters) may contain links or otherwise provide access to third party websites and services. Please be aware that TemperPack has no control over the policies and practices of third party websites or businesses as to privacy or anything else, and is not responsible for the privacy practices of such other companies. TemperPack encourages users to be aware when they leave this Site and to read the privacy statements of each website they visit. While TemperPack carefully chooses the websites to link to, this Privacy Policy applies solely to information collected on this Site.

How to Change Preferences and Control Your Personal Information

If you do not want to receive email communications from us, please indicate your preference by clicking on the “Unsubscribe” link at the bottom of an email message. Children's Privacy

TemperPack is committed to protecting the privacy of young children, and therefore does not knowingly collect or maintain Personal Information from persons under 13 years of age, and no part of our Site is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER. Updates to the Privacy Policy

We reserve the right to change, modify, amend or update this Privacy Policy at any time with or without prior notice at our sole and absolute discretion to the extent permitted by law. Your access or use of TemperPack’s Services following the effective date of any such changes constitutes your unconditional agreement to follow and be bound by such changes. You are responsible for reviewing this Privacy Policy each time you use or access the Site. A. Rights Under the California Consumer Privacy Act
This section provides additional information for California residents under the California Consumer Privacy Act (“CCPA”) and any effective amendments thereto. The terms used in this section have the same meaning as those used in CCPA. This section does not apply to information that is not considered “Personal Information” under CCPA such as anonymous, deidentified, aggregated, or public information.

 

B. Personal Information Collected
The chart below describes the Personal Information we have collected, used, and disclosed in the past 12 months. We do not “sell” any Personal Information as that term is defined under the CCPA.
The business or commercial purposes for which we collected, used, and disclosed your Personal Information include:

  1. Auditing relating to a current interaction with you, including but not limited to counting ad impressions, verifying positioning and quality of ad impressions, and compliance.
  2. Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  3. Debugging to identify and repair errors that impair existing intended functionality.
  4. Performing services on behalf of ourselves or a service provider or contractor, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, providing advertising or marketing services, providing analytic services, or providing similar services.
  5. Undertaking internal research for technological development and demonstration.

D. Right to Correct
Beginning January 1, 2023, California residents will have the right to correct inaccuracies in your Personal Information that we have collected, taking into account the nature of the Personal Information and the purposes of processing the Personal Information. E. Right to Delete

F. Right to Opt Out
California residents have the right to direct us not to sell or share your Personal Information. In the preceding 12 months, TemperPack has not sold or “shared” any Personal Information as those terms are defined under CCPA. G. Right to Non-Discrimination
California residents have a right to not receive discriminatory treatment by TemperPack for exercising any of your privacy rights under the CCPA. TemperPack will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CCPA, including, but not limited to: (i) denying goods or services, (ii) charging different prices or rates for goods and services, including through the use of discounts or other benefits or imposing penalties, (iii) providing a different level or quality of goods or services, (iv) suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services. TemperPack may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to TemperPack by your data.

 

H. Authorized Agents
You may designate an authorized agent to make a request under the CCPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.

J. Verification and Response Process
When you make a request under your “Right to Know” “Right to Correct,” or “Right to Delete,” you can expect the following:

  1. Verification: We will verify your identity. You will need to provide us the following: (i) sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
  2. Confirmation: We will confirm our receipt of your request within 10 days.
  3. Response: We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  4. Denials: In certain cases, a request to access, correct, or delete may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order.

 

We may also deny a request for deletion if it is necessary for us or a service provider or contractor to maintain your Personal Information in order to:

  1. Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us.
  2. Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
  3. Debug to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another customer to exercise their right of free speech, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act.
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with your expectations based on our relationship.
  8. Comply with a legal obligation.
  9. Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

 

If we deny any of your requests, we will explain why we denied it. If there is a portion of your request that we can comply with, for example deleting some of the requested information, then we will do so.
