This privacy policy (“Privacy Policy”) explains how Temperpack (“we,” “us,” or “our”), collects, uses, shares, and protects your Personal Information (defined below) whenever you access or use our products and services including visiting our Site (collectively, the “Services”).

Temperpack is committed to respecting and protecting your privacy. Please read this Privacy Policy carefully in order to understand our policies and practices regarding how we handle your Personal Information. This Privacy Policy is incorporated into and made part of our  Terms and Conditions . You can find out more information regarding your rights and responsibilities in using the Services by reviewing our Terms and Conditions. We reserve the right to update and/or modify this Privacy Policy from time to time.  If we make material changes, we will notify you by posting the revised Privacy Policy on this Site with an updated effective date and, where feasible, by sending an email notification to users who have provided their email address to us.  We encourage you to review this Privacy Policy periodically.  Your continued use of our Services following notice of material changes constitutes your acceptance of those changes.  If you do not agree with a revised Privacy Policy, please discontinue use of the Services.

This Policy only applies to Temperpack and its Services and not to websites, apps, or services of any other company or organization, including those linked to or through the Site, which may have different policies. We encourage you to review all privacy policies and terms of use of each Site that you visit. We are not responsible for the actions of those third parties, including their policies and practices with regard to your Personal Information.

Types of Information Collected

Temperpack collects two types of information from visitors to the Site, non-personal information and Personal Information. Non-personal information is information that does not, by itself, identify a visitor individually. Personal Information is information that identifies an individual or is reasonably capable of being associated with or linked, directly or indirectly, with an individual. It does not include aggregate, de-identified, or anonymous information. When you interact with us, we may ask you to supply us with Personal Information so that we can provide, enhance, and personalize our Services.

For example, Temperpack may collect Personal Information that you directly provide to us such as your name, address, telephone number, and email address. This information may be given when you sign up to receive Temperpack newsletters, or provide contact information about yourself to use our Services.

Temperpack also collects certain types of Personal Information automatically when you visit the Site, such as your IP address and approximate device location derived from your IP address or, where you have granted permission, more precise geolocation data.

Temperpack may automatically collect information during your visit to the Site such as page hits, number of visits, web pages viewed, length of visits, browser type and language, access times, the address of the website from which you arrived at the Site, and clickstream behavior (i.e., the pages you view, the links you click, and other actions you take in connection with Temperpack websites).

We may also receive Personal Information about you from third-party sources, such as business partners, marketing and data analytic providers, and publicly available sources, which may combine with information we collect directly from you or automatically.

Cookies and Similar Technologies

Cookies

“Cookies” are pieces of information that a website transfers and stores on a visitor’s computer in order to store information about the visitor’s preferences, enable certain website features, and support our marketing and analytics activities.   We use cookies and similar technologies (such as pixel tags, web beacons, and local storage) for the following purposes, organized by category:  

·      Strictly Necessary:  Required for the Site to function (e.g., security, session management).  These cannot be disabled.

·      Functional/Preference:  Remember your preferences and settings to enhance your experience.

·      Analytics/Performance:  Collect information about how visitors use our Site (e.g., Google Analytics) to help us improve our Services.

Global Privacy Control and Opt-Out Preference Signals

We honor opt-out preference signals, including the Global Privacy Control ("GPC"). If you have enabled GPC on your browser, we will treat that signal as a request to opt you out of the sale and sharing of your personal information and the use of your personal information for targeted advertising, to the extent required by applicable law. Note that GPC signals are processed on a per-browser and per-device basis and do not affect data previously collected.

Do Not Track

Some web browsers include a “Do Not Track” (DNT) feature that signals websites you visit that you do not want your online activities tracked.  There is currently no uniform standard for how companies should response to DNT signals.  Our Site does not alter its data collection practices in response to browser-level DNT signals.  However, we do provide you with meaningful choices about the collection and use of your data through our cookie preference center and the opt-out mechanisms described in this Privacy Policy and in Your Privacy Rights sections below.  

Information Use and Sharing

We are committed to maintaining your trust, and we want you to understand when and with whom we may share information collected about you. We use your Personal Information to provide you with our Services as described below. We do not sell your personal information, and we do not share your personal information with third parties for their own direct marketing purposes without your consent.

We may use your Personal Information for the following purposes:

·      To communicate with you about our products, services, and promotions;

·      To respond to your inquiries and provide customer support;

·      To conduct analytics and research to better understand how our Services are used;

A. Authorized Service Providers and Contractors

We share your Personal Information with service providers and contractors for business purposes to help us with specialized services such as customer support, email deployment, business analytics, marketing, and data processing.   These service providers are contractually required to protect the confidentiality and security of your Personal Information and to use it only for the purposes of which it was disclosed to them, consistent with this Privacy Policy.

B. Google Analytics and Google AdWords

We use Google Analytics on our Site to help us analyze traffic and improve services. Google Analytics may use cookies and similar technologies to collect information about your use of the Site, which is transmitted to Google.  We have enabled Google Analytics Advertising Features, including remarketing and Google Signals, which may link your Site visits with your Google account.  For more information on Google Analytics’ processing of Personal Information, please see http://www.google.com/policies/privacy/partners/. We also use Google Ads (formerly Google AdWords) remarketing to display advertisements to previous visitors of our Site across third-party websites and the Google Display Network.  Third-party vendors, including Google, may use cookies and other tracking technologies to serve ads based on prior visits to our Site.  Google’s use of advertising cookies enables it and its partners to serve ads based on your visits to this and other websites.  Your interactions with these ads are subject to Google’s own privacy policy, available at https://policies.google.com/privacy.   You can set your preferences for how Google advertises to you using the Google Ad Preferences page: https://adssettings.google.com

C. Third Parties

Temperpack may share Personal Information with third parties for business purposes, such as consultants and advisors to the company.

Temperpack may disclose your Personal Information to a third party if required to do so by law or if, in good faith, Temperpack believes that such action is necessary to: (1) comply with the law or with legal process; (2) protect and defend Temperpack’s rights and property or prevent fraud; (3) protect Temperpack against abuse, misuse, or unauthorized use of Temperpack’s products or services; or (4) protect the personal safety or property of its personnel, users of this Site, or the public.

Temperpack may transfer its database, including Personal Information contained therein, to a third party who acquires all or substantially all of the assets or stock of Temperpack whether by merger, acquisition, reorganization, or otherwise.  We will provide notice of any such transfer and you may have the right to withdraw your data under applicable law.

Temperpack may share non-personal information from which individuals cannot be identified, and which do not relate to individuals in aggregate form, with third parties for business purposes, such as consultants and advisors to the company.

Information Retention

We will only keep Your Personal Information for as long as necessary to fulfill the purposes for which we collect the information, as described in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.   If you request deletion of your Personal Information, we will process your request in accordance with the “Your Privacy Rights” sections below.  Note that certain information may be retained longer as required by law or for legitimate business purposes (e.g., to complete a pending transaction, satisfy tax or financial obligations, resolve disputes, or enforce our agreements).

How TemperPack Protects Your Information

We maintain industry-standard electronic, physical, and procedural safeguards to protect the security and integrity of your Personal Information.  These measures include, for example, encryption of data in transit and at rest, access controls, and regular security assessments.  We maintain an incident response plan to address security incidents and comply with applicable breach notification requirements. However, the storage, use, and transmission of information over the internet can never be made 100% secure. Accordingly, we do not warrant the security or confidentiality of your Personal Information, and you provide such information to us at your own risk.

Specifically, if you submit business plan ideas, financials, or other proprietary information to Temperpack through the Site, Temperpack CANNOT AND WILL NOT ACCEPT RESPONSIBILITY for protecting against misuse or disclosure of any confidential or proprietary information included in such materials, in the absence of Temperpack’s express, signed written agreement to do so.

International Data Transfers

Temperpack is headquarted in the United States, and your Personal Information may be transferred to, stored, and processed in the United States or other countries in which we or our service providers operate.  Data protection laws in those countries may differ from those in your home country.

For Users in the European Economic Area (EEA) and United Kingdom (UK):  If you are located in the EEA or UK, please note that Temperpack’s primary services are directed to customers in the United States, though we do conduct limited business with UK and EU customers.  Where we collect Personal Data (as defined under the GDPR or UK GDPR) from EEA or UK data subjects in connection with such business, we rely on one or more of the following lawful bases for processing under Article 6 of the GDPR/UK GDPR:  (a) performance of a contract with you; (b) compliance with a legal obligation; (c) our legitimate interests (including Site analytics, fraud prevention, and improving our Services); or (d) your consent, where required.

EEA and UK data subjects have certain rights with respect to their Personal Data, including the right to access, rectify, erase, restrict processing, data portability, and the right to object to processing.  To exercise these rights, please contact us at privacy@temperpack.com.  You also have the right to lodge a complaint with your local data protection authority.

Linked Websites

Our Services (including, without limitation, this Site and such features as Temperpack’s newsletters) may contain links or otherwise provide access to third party websites and services. Please be aware that Temperpack has no control over the policies and practices of third party websites or businesses as to privacy or anything else, and is not responsible for the privacy practices of such other companies. Temperpack encourages users to be aware when they leave this Site and to read the privacy statements of each website they visit. While Temperpack carefully chooses the websites to link to, this Privacy Policy applies solely to information collected on this Site..

How to Control Your Personal Information

If you do not want to receive email communications from us, please indicate your preference by clicking on the “Unsubscribe” link at the bottom of an email message. You may also  exercise your privacy rights (including the right to access, correct, delete, opt out, or obtain a portable copy of) to your personal information collected by Temperpack by contacting us at privacy@Temperpack.com.  Specific rights available to you based on your state of residence are described in the sections below.

Children's Privacy

Temperpack is committed to protecting the privacy of young children, and therefore does not knowingly collect or maintain Personal Information from persons under the age of 13 without verifiable parental consent, and no part of our Site is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER. In the event that Temperpack discovers that personal information has been collected from a person under 13 years of age, without verified parental consent in accordance with the Children’s Online Privacy Protection Act (“COPPA”) as amended by the FTC’s updated COPPA Rule effective April 22, 2025, Temperpack will delete such information. If you believe that we might have any Personal Information from a child under 13, please contact us via email at privacy@Temperpack.com.

Additionally, consistent with Virginia’s Consumer Data Protection Act (as amended effective January 1, 2025), we do not process the Personal Information of a known child under the age of 13 for purposes of targeted advertising, profiling, or the sale of personal data without first obtaining verifiable parental consent.  

Updates to the Privacy Policy

We reserve the right to change, modify, amend or update this Privacy Policy at any time with or without prior notice at our sole and absolute discretion to the extent permitted by law.   For material changes, we will provide notice as described in the “Your Privacy Matters” section above.  Your continued use of the Services following notice of material changes constitutes your acceptance of those changes.  If you do not agree to changes in this Privacy Policy, please discontinue your use of our Services

Your Privacy Rights – All U.S. Residents

Depending on your state of residence, you may have certain rights with respect to your Personal Information. As a general matter, residents of many U.S. states — including but not limited to Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, New Jersey, Nebraska, Iowa, New Hampshire, Tennessee, Minnesota, Maryland, and others — have the right to:

  • Opt Out of Sale/Sharing: Opt out of the "sale" or "sharing" (as those terms are defined under applicable state law) of your Personal Information. We do not currently sell or share Personal Information for cross-context behavioral advertising purposes;
  • Opt Out of Targeted Advertising: Opt out of the processing of your Personal Information for targeted advertising;
  • Opt Out of Profiling: Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you; and

We will not discriminate against you for exercising any of these rights. We will verify your identity before processing your request and will respond within the timeframe required by applicable law (generally 45 days, with an extension of up to an additional 45 days where reasonably necessary). Virginia Resident Privacy Rights (VCDPA)

This section provides additional information for residents of Virginia under the Virginia Consumer Data Protection Act ("VCDPA"), effective January 1, 2023, as amended.

In addition to the rights described in the "Your Privacy Rights" section above, Virginia residents may exercise the following rights with respect to their Personal Data (as defined under the VCDPA):

  • Right to Confirm and Access: The right to confirm whether we are processing your Personal Data and to access it;
  • Right to Correct: The right to correct inaccuracies in your Personal Data;

A. Rights Under the California Consumer Privacy Act
This section provides additional information for California residents under the California Consumer Privacy Act (“CCPA”). The terms used in this section have the same meaning as those used in CCPA. This section does not apply to information that is not considered “Personal Information” under CCPA such as anonymous, deidentified, aggregated, or public information.

B. Personal Information Collected
The chart below describes the Personal Information we have collected, used, and disclosed in the past 12 months. We do not “sell” any Personal Information as that term is defined under the CCPA/CPRA.

The business or commercial purposes for which we collected, used, and disclosed your Personal Information include:

  1. Auditing relating to a current interaction with you, including but not limited to counting ad impressions, verifying positioning and quality of ad impressions, and compliance;
  2. Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  3. Debugging to identify and repair errors that impair existing intended functionality;
  4. Performing services on behalf of ourselves or a service provider or contractor, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, providing advertising or marketing services, providing analytic services, or providing similar services;
  5. Undertaking internal research for technological development and demonstration; and
  6. Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

C. Right to Know

D. Right to Correct
California residents have the right to correct inaccuracies in your Personal Information that we have collected, taking into account the nature of the Personal Information and the purposes of processing the Personal Information. E. Right to Delete
California residents have a right to request the deletion of your Personal Information collected or maintained by Temperpack. To submit a request under your Right to Delete, contact us using the information provided below in Exercising Your CCPA Rights.

F. Right to Opt Out of Sale or Sharing
California residents have the right to direct us not to “sell” or “share” your Personal Information (as those terms are defined under the CPRA, including sharing for cross-context behavioral advertising). In the preceding 12 months, Temperpack has not sold or shared any Personal Information as those terms are defined under CCPA/CPRA. If this changes, we will update this section and provided a “Do Not Sell or Share My Personal Information’ link to our homepage.  If you have any questions regarding this, please contact us using the information provided below in Exercising Your CCPA Rights.

F2.  Right to Limit Use of Sensitive Personal Information

To the extent Temperpack collects Sensitive Personal Information (as defined under the CPRA), California residents have the right to direct us to limit the use and disclosure of such Sensitive Personal Information to uses necessary to provide the services or goods requested, or as otherwise permitted under the CPRA. TemperPack does not use Sensitive Personal Information collected from website visitors for purposes other than those permitted under the CPRA. G. Right to Non-Discrimination
California residents have a right to not receive discriminatory treatment by Temperpack for exercising any of your privacy rights under the CCPA. Temperpack will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CCPA, including, but not limited to: (i) denying goods or services, (ii) charging different prices or rates for goods and services, including through the use of discounts or other benefits or imposing penalties, (iii) providing a different level or quality of goods or services, (iv) suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services. Temperpack may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to Temperpack by your data.

H. Authorized Agents
You may designate an authorized agent to make a request under the CCPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.

J. Verification and Response Process
When you make a request under your “Right to Know” “Right to Correct,” or “Right to Delete,” you can expect the following:

  1. Verification: We will verify your identity. You will need to provide us the following: (i) sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
  2. Confirmation: We will confirm our receipt of your request within 10 days.
  3. Response: We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  4. Denials: In certain cases, a request to access, correct, or delete may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order.

We may also deny a request for deletion if it is necessary for us or a service provider or contractor to maintain your Personal Information in order to:

  1. Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us.
  2. Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
  3. Debug to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another customer to exercise their right of free speech, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act.
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with your expectations based on our relationship.
  8. Comply with a legal obligation.
  9. Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

If we deny any of your requests, we will explain why we denied it. If there is a portion of your request that we can comply with, for example deleting some of the requested information, then we will do so.

K. Right to Appeal

If Temperpack denies your CCPA/CPRA request, you may appeal that decision by contacting us at privacy@temperpack.com within a reasonable period after receiving our denial. We will review your appeal and respond within 45 days. If your appeal is unsuccessful, you may submit a complaint to the California Privacy Protection Agency (CPPA) at cppa.ca.gov.
